　　原来，苏某于1999年3月10日开设了股票账户，并于离婚前购入“四环生物”13824股及“基金景宏”200股，价值3万多元。离婚后，苏某通过股票买卖，使股票价值升至近10万元。

　　日前，市中级人民法院开庭审理此案。庭审中，梁女士认为，前夫故意隐瞒夫妻共有财产，请求法院判决该股票市值的一半约5万元归其所有。

　　法院认为，苏某的开户时间是在婚姻存续期，所以该账户的全部资金及股票均是夫妻共有财产。离婚后，苏某并未向该证券账户存入现金，该账户目前的股票及现金全部是夫妻共有财产及其增值部分。离婚后，苏某在同一账户中买卖股票的行为，是管理夫妻共有财产的行为。苏某在离婚时，故意隐瞒夫妻共有财产，是严重的违法行为。在分配被隐瞒的财产时，应少分给苏某。故广州市中级人民法院判决，该股票的70%(价值近7万元)归梁女士所有。
